PREAMBLE

This Privacy Policy (the “Policy”) reflects the commitment of PRODUITS MATRA INC. to ensuring the security and protection of the confidentiality of personal and confidential information in the course of its activities.

PRODUITS MATRA INC. collects, stores, and processes the personal and confidential information of its users and therefore undertakes to comply with the provisions, values, and fundamental principles set out in applicable legislation, including the Act respecting the protection of personal information in the private sector (chapter P‑39.1) and its regulations (collectively, the “ Act ”), the Civil Code of Québec, and the Professional Code (chapter C-26). This Policy informs users of how PRODUITS MATRA INC. intends to use and protect the information provided by users through its website. Only information strictly necessary for the use of PRODUITS MATRA INC.’s website is collected.

Users are invited to read this Policy carefully. By using the website, users agree to this Privacy Policy. If you do not agree with its terms, please do not use the Site.

  1. DEFINITIONS

Unless the context indicates otherwise, the following terms, when used in this Policy, have the meanings set out below :

  • “Confidentiality Incident” means the loss of personal information, any breach of its protection, or any unauthorized access, use, or disclosure of Personal Information under the Act.
  • “Cookies” means small files (information elements) sent by a server and stored on a user’s computer hard drive, sometimes without the user’s knowledge, when the user visits certain websites. Cookies store information in order to recognize the user during a subsequent visit.
  • “Information” means all Personal and/or Confidential Information as well as Technical Information.
  • “Intellectual Property” means all information contained on a website, including products, methods, improvements, logos, or images that may be protected under the Patent Act (R.S.C. (1985), c. P-4), the Copyright Act (R.S.C. (1985), c. C-42), the Trademarks Act (R.S.C. (1985), c. T-13), whether or not such rights are registered or subject to an application for registration, or protected under any other applicable law.
  • “Personal and/or Confidential Information” means any information relating to an identified or identifiable individual or legal entity, directly or indirectly, by reference to an identification number or to one or more specific factors, except as otherwise provided by applicable laws. Personal information makes it possible to identify a person and may include information such as an address, telephone number, health status, lifestyle habits, or financial situation. Confidential Information includes Personal Information, as well as financial or other information that must be treated confidentially.
  • “Privacy Impact Assessment” or “PIA” means an analysis conducted before the implementation of a project and, where necessary, throughout its lifecycle, to assess its potential impact on the privacy of the individuals concerned when Personal Information is processed. A Privacy Impact Assessment includes, among other things, verifying compliance with applicable laws, identifying privacy risks, and determining appropriate measures to prevent or mitigate such risks.
  • “Site(s)” means all websites and Internet pages operated by PRODUITS MATRA INC., including, where applicable, its social media pages such as Facebook and LinkedIn.
  • “Technical Information” means any information collected through log files and cookies, as further described in this Policy. Technical Information does not constitute Personal or Confidential Information.
  • “User(s)” means means any individual or legal entity using PRODUITS MATRA INC.’s Site.

  1. PURPOSE

By adopting this Policy, PRODUITS MATRA INC. affirms its commitment to ensuring strong governance in the protection of Personal Information. This Policy was developed to provide information to all concerned parties about the reasons for and methods of collecting and managing personal data. The primary objective of PRODUITS MATRA INC. is to ensure the security and confidentiality of personal information throughout its retention and processing.

This Policy also aims to provide guidance and to define the roles and responsibilities of stakeholders involved throughout the lifecycle of Personal Information. It applies to all employees who have responsibilities in this area, as well as to partners, collaborators, subcontractors, and any other person likely to provide personal information to PRODUITS MATRA INC. This Policy was developed in order to :

  • comply with the requirements of the Act;
  • provide overall guidance and support senior management of PRODUITS MATRA INC. in decision-making regarding the selection of Personal Information protection measures; and
  • clearly define the roles and obligations of all parties involved in the protection of Personal Information.

The following procedures, which stem from this Policy, set out the processes and tools necessary to protect Personal Information. They are intended to raise awareness among all stakeholders of the importance of properly protecting Personal Information and to guide them in their efforts to do so :

  • Personal Information retention, destruction, and anonymization procedure;
  • Personal Information access request and complaint handling procedure;
  • De-indexing and deletion request procedure;
  • Confidentiality Incident management procedure;
  • Privacy Impact Assessment procedure.
  1. PERSONAL AND CONFIDENTIAL INFORMATION
  1. Personal and Confidential Information Collected

Through PRODUITS MATRA INC.’s Site, the company may collect and retain the Personal and Confidential Information listed below, including when a User completes an electronic form available on the Site :

  • First and last name;
  • Company name, where applicable;
  • Email address;
  • Telephone and fax number;
  • Résumé (CV).

PRODUITS MATRA INC. acknowledges that Personal Information contained in a résumé may be considered sensitive within the meaning of the Act. Therefore, such Personal Information is subject to enhanced protection measures.

  1. Methods of Collecting Personal and Confidential Information

Before collecting personal and confidential information, PRODUITS MATRA INC. informs the individual concerned of the purposes of the collection, how the information will be used, and obtains the individual’s consent through this Policy.

Users’ Personal and Confidential Information is collected through various forms and questionnaires, including the spontaneous application form available on the main page of the Site, forms related to specific job postings under the “Careers” section, or when a User subscribes to the newsletter or any other mailing list of PRODUITS MATRA INC.

In addition, Users’ Personal and Confidential Information may also be collected through interactions between the User and the Site, that is, based on how the User uses the Site.

  1. TECHNICAL INFORMATION
  1. Technical Information Collected

When a User accesses the Site, PRODUITS MATRA INC. automatically collects certain Information through various technological tools, such as log files, Cookies, and the website analytics tool provided by Google, namely Google Analytics, a web audience measurement tool.

This information mainly includes the following Technical Information :

  • the Internet service provider’s domain name and the User’s IP address. In general, an IP address is a unique number assigned by an Internet service provider that allows a user to connect to the Internet and route information to them. This unique number is automatically logged by web servers;
  • the type of browser used (for example, Firefox or Internet Explorer) and the User’s operating system (for example, Windows or macOS);
  • the date and time at which the User accesses the Site;
  • the pages and links visited by the User and the duration of such visits;
  • the different technologies used to access the Site;
  • the country from which the connection originates; and
  • the address of the third-party website used to access the Site (referring site), where applicable.

This Technical Information is not used to obtain Personal or Confidential Information about Users. It is collected solely for practical and statistical purposes and to improve the Site in order to better meet Users’ needs and preferences. A Cookie may be required due to technological or security constraints inherent to Internet browsing or to ensure the proper functioning of the Site.

Users may choose at any time to enable or disable Cookies. Most Internet browsers allow users to delete Cookies from their hard drive, block Cookies, or receive a warning before Cookies are stored on their device. Users who refuse Cookies will still be able to access the Site; however, navigation may be affected and certain features may not be available. Cookies are used solely to record information related to navigation on the Site.

  1. Purpose of Cookies

Cookies are collected to better understand the behavior of Users visiting the Site. In particular, they make it possible to identify which parts of the Site are most frequently visited. Cookies therefore help improve marketing content, search functionality, and overall Site navigation. Cookies are stored locally on the User’s computer, tablet, or mobile phone, depending on the device used to access the Site. It is not necessary to use Cookies in order to browse the Site. However, if Cookies are disabled, certain sections or features of the Site may no longer be accessible or function properly. When Users accept the use of Cookies, PRODUITS MATRA INC. automatically collects information, as is the case for most websites, and records it in the log files mentioned above. This information is largely similar to the non-personal information described previously. In order to manage Cookies in accordance with Users’ preferences, Users are encouraged to configure their browser settings based on the intended purpose of Cookies.

There are three (3) types of Cookies: essential Cookies, performance Cookies, and functionality Cookies. Essential Cookies allow Users to access all features of the Site and to navigate it properly. Performance Cookies help optimize the Site and simplify navigation. Finally, functionality Cookies allow the Site to remember choices made by Users during their browsing experience, such as their geographic location, so that the Site can adapt the language accordingly. These types of Cookies do not make it possible to identify Users and do not track their activity outside the Site. They involve non-personal and therefore anonymous information.

  1. PURPOSES OF COLLECTION OF INFORMATION

Users are not required to provide any Personal or Confidential Information in order to access the Site. However, Users must provide Personal Information in order to complete the forms and questionnaires available on the Site.

When PRODUITS MATRA INC. collects and retains Information, its objective is to provide Users with a personalized and secure service, in compliance with applicable laws and its security rules.

In general, all Information provided by Users to PRODUITS MATRA INC., regardless of the method of collection, enables PRODUITS MATRA INC., in particular, to :

  • verify the User’s identity;
  • improve the personalized welcome and user experience on the Site;
  • provide Users with the information or services requested;
  • inform Users of new Site features and updates;
  • ensure effective communication between Users and PRODUITS MATRA INC.’s technical support team in order to improve the Site;
  • develop statistical data; and
  • prevent or detect hacking attempts, security breaches, or any other security risks related to the Site, including for loss prevention and fraud prevention purposes.

All Information collected may also be used to generate anonymous statistics, including to calculate the number of visitors to the Site, identify the most frequently visited pages, analyze the different technologies used by Users, determine the countries from which Users connect, identify referring websites, and improve the overall user experience, Site navigation, and content.

This Information also helps ensure that the Site’s features are properly adapted to Users’ needs.

  1. SECURITY AND PROTECTION OF INFORMATION

The Personal Information collected by PRODUITS MATRA INC. is limited to what is considered essential and is protected in the same manner as the its own confidential information. Such Information is stored in a secure environment. All employees of PRODUITS MATRA INC. are required to respect the confidentiality of Personal and Confidential Information. Personal and Confidential Information is retained only for the period necessary to achieve the purpose for which it was provided by the User. Technical Information is retained for as long as the purpose for which it was collected has not been fulfilled. Once these purposes have been achieved, the Information is deleted and no longer processed.

PRODUITS MATRA INC. is committed to implementing a combination of technological, organizational, human, legal, and ethical measures to ensure the security of Information. To protect Users’ Information, PRODUITS MATRA INC. uses or may use, among other things, the following measures :

  • use of secure data processing software;
  • Secure Sockets Layer (SSL) protocol;
  • network monitoring software;
  • computer backups;
  • development and use of digital certificates; 
  • firewalls.
  • PRODUITS MATRA INC. has implemented a Confidentiality Incident management process relating to Personal Information in order to respond as effectively as possible to any potential incident;
  • The person or persons affected by a breach will be notified. PRODUITS MATRA INC. undertakes to take all necessary measures to limit the risk of harm to the individuals concerned;
  • In the event of a Confidentiality Incident involving personal information, PRODUITS MATRA INC. will take the following actions:
    • take reasonable measures to reduce the risk of harm to the individuals concerned and to prevent similar incidents from occurring;
    • notify the Commission d’accès à l’information du Québec (CAI) and the individual concerned if the incident presents a risk of serious harm; and
    • maintain a register of Confidentiality Incidents, a copy of which will be provided to the CAI upon request.

  1. TRANSFER OF PERSONAL INFORMATION

PRODUITS MATRA INC. does not sell or rent the User’s Personal or Confidential Information to any third party. However, such information may be shared with third parties acting on behalf of PRODUITS MATRA INC. for marketing purposes, or with service providers, subcontractors, or other third parties assisting PRODUITS MATRA INC. in resolving technical issues. In such cases, these third parties are also required to respect the confidentiality of the User’s Personal Information.

PRODUITS MATRA INC. reserves the right to access, retain, and disclose the User’s Personal or Confidential Information, without the User’s consent, in the following circumstances :

  • where required by law or ordered by a court, administrative body, or government authority;
  • in response to a legal request, such as a search warrant, court order, or similar process, where required by law;
  • where necessary to establish or recover amounts owed to PRODUITS MATRA INC.; and
  • where the Information is publicly available.

PRODUITS MATRA INC. undertakes to communicate directly and as promptly as possible with the individuals concerned in order to inform them of the scope of the disclosure, the reasons for such disclosure, and the authority to which the Information was disclosed.

PRODUITS MATRA INC. undertakes to comply with all applicable regulations relating to data transfers and limits such transfers strictly to what is necessary for the purposes of processing.

Before any Personal Information is communicated outside of Québec, PRODUITS MATRA INC. undertakes to conduct a PIA and ensures that the Information disclosed is subject to a level of protection at least equivalent to that required under the Act.

  1. USE OF WEBSITE

Users agree not to use the Site in an unlawful or prohibited manner. Without limiting the foregoing, Users agree not to:

  • transmit any content that may constitute, including but not limited to, incitement to commit crimes or offences;
  • attempt to mislead PRODUITS MATRA INC. or other Users by impersonating another person or misusing another person’s name, identity, or business name;
  • collect or store Personal or Confidential Information relating to other Users;
  • intentionally or unintentionally violate any applicable national or international laws or regulations;
  • copy, redistribute, modify, reproduce, or republish, in any form whatsoever, the information contained on the Site; or
  • use the information contained on the Site for prohibited personal purposes, such as reselling such information.
  1. USER RIGHTS

Subject to the exceptions provided for under the Act, Users have the right at all times to access, rectify, and object to the processing of their Personal or Confidential Information. If a User wishes to withdraw their consent to the collection of their Personal Information, contest the processing, access, obtain a copy of, correct, or delete their Personal or Confidential Information collected by PRODUITS MATRA INC., the User must contact PRODUITS MATRA INC. by telephone, email, or mail using the contact information set out in Section 18 below, or submit a written request using the form available on the Site through the “Contact Us” link. The User must indicate their first and last name, as well as the email address used at the time of registration.

Upon receipt of a request for correction, the processing of the relevant Personal Information will be restricted until the correction or deletion has been completed.

In accordance with applicable laws, PRODUITS MATRA INC. undertakes to comply with any request for withdrawal of consent, rectification, or destruction of Personal or Confidential Information, unless otherwise required by law.

Users may, except where such request would cause serious practical difficulties, request that their Personal Information be communicated to them in a structured and commonly used technological format.

Users must promptly notify PRODUITS MATRA INC. of any changes to their Personal or Confidential Information.

Users may unsubscribe from newsletters or marketing emails at any time by clicking on the unsubscribe link included at the bottom of each email or by contacting customer service.

  1. ROLES AND RESPONSABILITIES
  1. Senior Management of PRODUITS MATRA INC.
  • establishes the policies and practices governing the protection of Personal Information and publishes clear and detailed information about them on the Company’s website;
  • implements all necessary security measures to ensure the protection of Personal Information that is collected, processed, disclosed, retained, and destroyed, while complying with the rules governing consent for the collection, disclosure, and use of Personal Information;
  • designates a person responsible for the protection of Personal Information and publishes the title and contact information of that person on the Company’s website;
  • complies with the requirements of the Act regarding the disclosure of Personal Information without the consent of the individual concerned for study, research, or statistical purposes, as well as in the context of a commercial transaction;
  • commits to putting in place the necessary resources (technical tools, documentation, training, and others) to raise awareness, inform, and train employees on the management of Personal Information;
  • ensures the protection of the Personal Information it holds throughout the entire lifecycle of such Information, including collection or creation, retention, use, and destruction;
  • complies with Information and transparency requirements toward individuals, with the rules governing the disclosure of Personal Information without consent (performance of a mandate or execution of a service or enterprise contract), including disclosures outside Québec, as well as all other requirements set out in the Act; and
  • ensures compliance with current legal requirements relating to requests for the portability of Personal Information.
  1. Person Responsible for the Protection of Personal Information
  • With respect to the protection of Personal Information, the person responsible ensures compliance with the obligations set out in the Act, provides advisory services, and raises awareness on matters relating to Personal Information protection; and
  • reports to senior management of PRODUITS MATRA INC. in accordance with the implementation terms set out in this Policy.
  1. Employees of PRODUITS MATRA INC.
  • Employees of PRODUITS MATRA INC. become familiar with and comply with this Policy; and
  • support the person responsible for the protection of Personal Information in the performance of their duties under the Act by respecting and applying the guidelines of this Policy and the related procedures.
  1. Partners and Collaborators of PRODUITS MATRA INC.
  • All third parties wishing to interact with PRODUITS MATRA INC. must review and consent in advance to the Policy governing the protection of Personal Information as it relates to their relationship with PRODUITS MATRA INC.
  1. DISPUTE RESOLUTION

Any dispute arising from this Policy, including its validity, interpretation, performance, consequences, or outcomes, shall be submitted exclusively to the court having jurisdiction in the judicial district of Beauce, Province of Québec.

This Policy shall be interpreted in accordance with the laws of Québec and Canada. In the event of a dispute relating to confidentiality, such dispute shall be governed by this Privacy Policy and decided by the competent court sitting in the judicial district of Beauce.

  1. CHANGES TO THE POLICY

This Privacy Policy may be amended or supplemented at any time by PRODUITS MATRA INC. in order to comply with any legislative, regulatory, jurisprudential, or technological developments. Any changes to this Privacy Policy will be published on the Site. By continuing to use the Site, Users agree to be bound by such changes.

PRODUITS MATRA INC. will not modify its practices or conditions in a manner that would reduce the level of security of the Personal or Confidential Information collected from Users without first obtaining the consent of the affected Users.

  1. GOVERNING LAW

This Privacy Policy is governed by the laws of Québec and Canada and was originally drafted in French. In the event of any inconsistency or discrepancy, the French version shall prevail, notwithstanding any translation of this Policy into another language.

The invalidity of any provision of this Privacy Policy shall not affect the validity of the Policy as a whole. The temporary or permanent non-application of one or more provisions shall not be construed as a waiver of the remaining provisions, which shall continue to have full force and effect.

  1. DISCLAIMER OF LIABILITY

PRODUITS MATRA INC. makes no representations or warranties regarding the accuracy, relevance, or reliability of the content of the Site, including with respect to any errors or omissions that may appear on the Site. The information contained on the Site is deemed accurate at the time it is published. PRODUITS MATRA INC. disclaims any liability arising from the use or interpretation of the information by Users.

PRODUITS MATRA INC. does not guarantee that the Site will be available at all times or without interruption, nor that the Site or the servers used to operate it will be free from viruses or malfunctions. Despite the efforts made by PRODUITS MATRA INC. to maintain access to the information on the Site and ensure its proper functioning, Users acknowledge that this does not constitute a guarantee of accuracy, reliability, or connectivity. PRODUITS MATRA INC. does not guarantee that the use of the Site or any part thereof will not infringe the rights of third parties and assumes no responsibility for any errors or omissions in any part of the Site.

Under no circumstances shall PRODUITS MATRA INC. be held liable for the loss or theft of data resulting from force majeure or a cybersecurity attack.

PRODUITS MATRA INC. disclaims all liability for any damages, whether direct, indirect, incidental, or punitive, that may result from the use of the Site, its content, or the inability to use the Site.

Users acknowledge that, unless otherwise indicated, the Site and all information published on it are the exclusive property of PRODUITS MATRA INC. and are subject, in particular, to the exclusive copyright held by PRODUITS MATRA INC.

The Site may contain names, terms, titles, trademarks, logos, icons, trade names, brand names, designs, domain names, or other forms of content that may constitute registered or unregistered trademarks or service marks. Intellectual Property is protected under Canadian and foreign laws. All rights are reserved by PRODUITS MATRA INC.

The Site may contain external links, including hyperlinks redirecting Users to third-party websites. All links to third-party websites are independent and are not under the control or responsibility of PRODUITS MATRA INC. Such links are provided solely for the convenience of Users. The websites to which they provide access are not governed by this Privacy Policy, but by their own terms of use and privacy policies. Users access such websites at their own risk. Users acknowledge that PRODUITS MATRA INC. cannot be held liable for the content, appearance, information requested by such websites, or for any damages of any kind arising from browsing or using those websites.
